Using the Website Welcome to CONIA.CO.KR (“Website” hereinafter). A customer is to agree with these terms and conditions (“Term” hereinafter) to use the website. Free use of the Website may be limited if you do not agree. CONIA.CO.KR is an online service of ACONICCO., LTD. (”Company” hereinafter) established to sell apparels, accessories, and others (“Products” hereinafter) to individual customers. But please note that the colors of actual products and the colors of products on the monitory may not match exactly due to the color clarity settings of customer’s personal monitors. Please read this Term carefully before making the purchase. The followings shall be fulfilled in order to purchase a product from this website. a) A valid credit card/debit card must be in possession. b) A guarantee of accuracy and validity of the personal information provided upon joining the website. Please contact our customer service center immediately via “Inquiry” on the bottom of the website when you have any changes in your personal information. You shall agree to not to impersonate, use an alias or a name with no authorization. Using this website means that you have agreed and comply with the contents of this term. The company can change the contents of this term with its sole discretion per further circumstances. After the changes of the term, using this website shall be considered as being agreed and complying with the changed terms. Ordering You shall pay the price stated per this term to purchase a product of CONIA.CO.KR. Ordering procedure proceeds with the series of website’s guide. Pressing the “Buy” button at the last step of the online purchasing procedure shall complete the order. As soon as the ordering is completed, the purchase related information including the order number and the credit/debit card withdrawing amount will be sent to the customer as an email. This email does not approve or confirm the order from CONIA.CO.KR. Except for the company disapproving the customer’s order or the customer canceling the order per below refund policy, the ordered item shall be sent from the company to the customer with a related email after the approval of the customer’s order and the contracted completed between the customer and the company. The company immediately sends the email indicating the date and time as soon as the customer approves the order. The date and time of receiving the email are applied regardless of customer receiving the email due to the reason of unable to control the date and time of receiving the email by the Company. When an order related information is necessary, please call the customer service center at 070-4632-2380 or “Inquiry” board at the bottom of the website. The company may disapprove the customer’s order when: (i) there are no quantities for the customer ordered item or, (ii) customer’s credit card expiration date is under 28 days from the ordered date or, (iii) customer’s payment was not approved or, (iv) item or price-related error has occurred. The company has the rights to deny the customer’s purchase decision at any time. When the order cannot be processed per customer’s order confirmation, the company shall contact the customer via an email or a phone call. The company is doing its best to match the quantities of the item on the website with the actual, but cannot guarantee that a specific item on the website is purchasable at all time. When the item ordered by the customer cannot be delivered, it shall be refunded to the customer’s account. Price and Delivery Policy a. Payment Currency: The payment shall be processed via customer selected currency. The available currency on final payment may be limited per the shipping address. Shipping country and currency can be changed at any time. The price shown when making the payment is the actual price to be paid by the customer. The price will not change even when the currency change occurs afterward. The refund shall be made by the price of purchasing point, not the refunding point. Customs and VAT Pre-payment: When the customer desires, the delivery duty paid can be unselected to make the customs and VAT payments on the delivery. When the customer wishes to pay the customs and VAT in advance, click the ‘Customs and VAT Pre-payment’ box displayed at the payment step to make the payment with the item. Customs relations are stated on the shopping bag and throughout the payment steps and applied to all shipping countries. If the customer does not wishes to purchase an item with delivery duty paid conditions, unclick the ‘Customs and VAT Pre-payment’ box displayed at the payment step. It is the customer’s responsibility to pay the necessary payments to receive the item. When additional fees are charged by item arriving at the customs, the shipping company will notify the charged fees to the customer by a phone call. The customer is obligated to pay the fees necessary for the purchased item to pass the customs of the country and it may cause the shipping to get delayed. If the customer chose not to pay the import duties, CONIA.CO.KR has the rights to claim additional fees. Making the purchase from the indicated countries may cause local import duties during the shipping process and paying the necessary fees to receive the product is the customer’s responsibility. Customs are appropriated with the application of fixed ratio to all item prices added total amount. When the customer thinks that the tax was charged excessively, please call the customer service center at 070-4632-2380 or “Inquiry” board at the bottom of the website. The company will check the inquiry and refund the differences if it has occurred. When it is not subjected to taxation relief, CONIA.CO.KR may charge the VAT of the place. The customer has the responsibility to report the VAT uncharged purchase assets and to pay the VAT related to the products that are not subjected to taxation relief in accordance with the law of the state. Ordering a product from CONIA.CO.KR means the customer has transferred the customs refund duty to the company and considered as being agreed to not to apply for the customs refund directly. The company shall deliver the product selected by the customer to the location and the name provided by the customer at the point of payment and shall do its best to deliver the item in shortest time and in the best condition. Shipping and handling charges are charged differently per the destination. Please refer to the shipping category for the shipping time and fees. Shipping time is for references only. CONIA.CO.KR is not responsible for the delivery delays caused by customs issues. The transportation processes for all purchased items are guaranteed by the company until they are delivered to the customer. To trace the product being delivered, please use the invoice number on the email sent to the customer or use the “Inquiry” board at the bottom of the site or contact the customer service center. Please place your order with the consideration of the time from the order to delivery to not to cause any physical and psychological damages by a delivery period. CONIA.CO.KR is not responsible for any issues caused by such. If the customer’s order is not delivered within the time posted at the point of order, the company shall notify it to the customer and will do the best to correct the situation. A new order shall be handled as a separate case. If the online purchased item from CONIA.CO.KR is delivered to the address other than the payment card holder’s address (ex: sending a gift to a friend’s address), the order related email and invoice copy shall be sent to the email and address registered by the cardholder and shall request a signature from the purchaser for completion of the delivery. Please see the shipping section for shipping related details. b. Return and Cancel The company prioritizes customer satisfaction and does its best to sincerely handle customer inquiries. The company wishes that the customers satisfied with the purchased products, but when a customer is unsatisfied with the product, a full refund is available. Please check the return policies for a more rapid returning process. All products must be returned with the delivered boxes. Please use the delivered boxes for safe delivery to not to damage the box during the return process. A customer can request a return within 14 days from the ordered date. When the return is approved, the return number can be verified via online and email. The unique return number will be sent by email. The returning product must be returned within 14 days after receiving the return number. Returning the products over 28 days shall be determined by the discretion of CONIA.CO.KR. The returning product must be in perfect condition with no signs of wearing and all CONIA.CO.KR and product tags must be attached. If the customer wishes to return a damaged, discolored or no label product, the company can reject the return and send the product back to the customer. Before the ordered product is shipped from the warehouse, the packaging team of the company confirms and manages the product. If the customer receives a damaged product, please contact the customer service center immediately. A designer brand product enclosed with an authentic warranty card, dust bag, and leather tag must be returned with all them. For shoes, there shall be no scratches or stains with no damages and returned in the brand boxes. Please wear your underwears to try underwears, swimsuits and bikini bottoms. Detached strings or dirty products may be rejected for return and can be returned to the customer. If there is a defect in the received product (ex: damaged or manufacturing defects), the product will be repaired or exchanged. Please contact the customer service center for details. For any case of canceling your order before the shipping for any reason, please contact the customer service center. To cancel your order, the cancellation request shall be made to the company. When the order is canceled, a full refund for the payment with shipping charges will be made within 14 days. (If you selected the shipping option having additional charges other than default shipping, the additional charges will be excluded.) If you want to cancel your order after the product has been shipped, you must notify the company within 14 days of product received date. Please send email to the customer service center as stated above. When the cancellation is made, the customer must return the product within 14 days of the date. The customer shall pay the expenses for returning the product. If the product was damaged by the customer, the customer has to pay the loss of the product’s value. Credit Card The products of CONIA.CO.KR can be purchased with online valid credit/debit cards. The customer’s credit card company can perform additional security checks to handle the order. All credit/debit card holders must get validity confirmation and approval from the card issued agency. If the customer’s card issuing agency does not approve or deny the payment for any reason, the company is not responsible for shipping delays or shipping cancellations. Ownership and Transfer of Risk Bearing The company has the legal ownership of the product until the customer makes full payment and the company receives the payment. As soon as the refund process is completed, the legal ownership of the product transfers to the company from the customer. When the product is shipped to the customer, the risk of the product is transferred to the customer. Refund CONIA.CO.KR wishes the customer to be satisfied with the company’s products. Only for the online purchase products, the company makes a full refund for unused, undamaged and not worn products. Trademarks, logos and service marks (“Trademarks”) on the web site are the registered and unregistered trademarks of CONIA.CO.KR, affiliates, license providers or partners and are protected by international trademark law. All the trademarks unowned by the company, affiliates, partners or license providers posting on the website are the properties of the owner and may or may not be related or sponsored or have a partnership with the company. Excluding the cases stated at below “Limited License” as a limited license or necessary by related laws, whole or part of any contents, trademarks and website cannot be used, reproduced, duplicated, copied, sell, resell, access, modify or any other methods without the written consent of the company. Limited License The company allows customers with a personally usable limited and cancelable nonexclusive license by accessing the website. Please note that the customer cannot use the whole or part of the website for frame or link or use the frame or link skills without the written consent of the company. The limited license of this section does not include the following rights. a) The rights to modify or download the website or website contents (except for caching or necessary to view the contents) b) The rights to use the website or contents other than personal use c) The rights to create derivations based on the website or contents d) The rights to gather account information for the profits of other parties e) The right to use the meta tag or other ‘hidden text’ using the company’s name or trademarks without clear written consents f) The right to use software robots, spiders, crawlers or similar data gathering and extracting tools or actions that can cause inappropriate issues to the company’s infrastructure. The customer is allowed with a limited and cancelable nonexclusive license to create hyperlinks connecting with the website’s home page for personal and non-commercial purposes. The followings are allowed for the websites link with the company’s website. a) Linking to the company’s contents (No duplicates) b) No mentioning of the company guaranteeing or recommending the website or the services and products. c) No distortion of relationships with the company. d) No unpleasant, indecent, aggressive or controversial contents shall be included and shall only include the contents for all ages. e) No descriptions of the company products or services in false, misleading, contemptuous or unpleasant behaviors and no combination of undesirable products, services or opinions with the company. f) No usage of the company’s trademarks without previous written consents g) No links are allowed to web pages other than the home page. With a sole discretion, the company can make a request to remove the website link and the link must be removed immediately when such request is made. The company has no responsibilities to audit or evaluate and does not guarantee the contents of the websites linked to the company’s website and has no responsibilities or obligations the actions, contents, and products. Also, the company has no responsibilities or obligations for the actions, contents, products or services of the websites and pages including the privacy policy and the terms of the site. Please review the terms and privacy policies of all visiting external pages and other websites carefully. Submissions Inquiries or opinions for purchase wanted products or using products are all welcomed. But unwanted proposals and ideas can be rejected per the company’s policy. Regardless of the company’s policy for unwanted proposals and ideas, all inquiries, opinions, proposals, ideas or other information (“submissions”) offered by customers are handled as nonexclusively and openly. In accordance with the company’s personal information protection policy, the rights for the information submitted by the customer are completely transferred to the company as nonexclusive, charge free and transferrable for use, duplicate, modify, convert, publish, sell, transfer, translate, derive, distribute and display as an independent or a part of others via any form, media and/or technology (currently usable or regardless of future development). Also, the customer is to recognize that the submissions will not be returned and the company can include but not limit the use of the customer’s submissions and the included ideas, concepts or know-how to the product development, production, distribution, and marketing. When creating a submission, the customer shall state and guarantee that the customer has the rights or can control the submission. Also, the customer shall state and guarantee that the submission does not include software viruses, commercial suggestions, linked letters, massive emails or any forms of ‘spam’. Using false email address, impersonating other person or organization or source of the submission to mislead the company is not allowed. It is agreed that the company is fully released from any legal responsibilities for all claims for compensations caused by customer’s arguments related to all rights involving the submission. The Company’s Responsibility for Customers A customer has certain rights for that the product ordered from this website is quality satisfactory, corresponds with the intention and the descriptions on the website corresponds with the customer’s order, in accordance by the law. If the company does not comply with this term, the company is responsible for the expected losses from the violation or negligence, but not responsible for unexpectable losses. A clear result of the company’s violation or expected losses by the customer and the company at the point of contracting this term is considered as an expectable. The company offers products, website use, and other services for domestic and personal use only. The customer agrees to not to use the company provided products, websites and other services for commercial, business or resell purposes, and the company shall not have any responsibilities for profit losses, business losses, business suspensions or business opportunity losses. As some countries do not allow the exclusion or limitation for the derived or additional losses, the responsibility of the company in the country shall be limited to the maximum legal allowed range. Any guarantees stated in this article does not affect the legal rights of the customer. General The customer recognizes and agrees that this term and privacy policy composes a full and exclusive contract to CONIA.CO.KR product purchasing and customer’s website use, and applied with the replacement of all previous proposals, contracts or other communications. If an article of this term is entirely or partially illegal or invalid or considered as unexceptionable, other articles and the remaining parts of the article are valid. If the company waivers an article on this term, it shall not be considered as the waiver for afterward violations or nonfulfillment and shall not affect other articles of this term. In accordance with this agreement, the concerned party cannot delay the execution of the rights, reliefs, authorities or privileges and shall be interpreted as the relinquish of the rights during the transactions between the parties, and shall not be interpreted as the actions to restrain the execution of means of relief and all or part of rights or other rights, means of relief, authority or privilege. The rights and means of reliefs provided by this term shall be accumulated and shall not exclude the rights or means of reliefs provided by the law. The time shall not be the core contents of this term in regards to time, date or period stated in this term. The contents included in this term shall not be interpreted as an establishment of a certain agency, partner or other forms of joint enterprise. The company has the rights to change this term in any time and it is recommended for the customers to read this term periodically to acknowledge the contents of this term fully. All modifications shall be immediately effective upon the modifications posted on the website. Customers continuously using the website shall be considered as agreeing with all terms. The company can waive the rights granted by this term regardless of advance notification. In such a case, all cancelation or other notifications of suspending the use of the website shall immediately comply. The company, for any reason, has the rights to refuse to supply products to a person, withdraw products from the website at any time or delete or remove data or contents on the website.
